By accessing or using EstimateAI ("Service"), operated by Visionary Solution LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms apply to all users, including contractors, subcontractors, and team members using the Service under any account.
EstimateAI is an AI-powered contractor estimation tool that allows users to generate project estimates, analyze job photos, manage client information, and produce professional quotes. The Service uses artificial intelligence (including GPT-4o) to process photos, measurements, and pricing data to assist contractors in creating estimates.
The Service provides AI-generated estimates for informational and assistance purposes only. Estimates are not guarantees of project cost, material requirements, or labor hours. You are solely responsible for verifying all measurements, pricing, scope, and accuracy before submitting any quote or proposal to clients.
To use the Service, you must create an account and provide accurate, complete information. You must be at least 18 years old and have the legal authority to bind any organization on whose behalf you act.
You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately at support@visionaryconsultant.net of any unauthorized use.

Subscription plans are billed monthly in advance. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. We will notify you of any pricing changes at least 30 days in advance.
Users on the Free plan may be subject to per-quote charges for estimates that exceed the free tier allowance. Per-quote charges are clearly disclosed before you generate an estimate and require your explicit confirmation before any charge is applied.
If you are not satisfied with EstimateAI within the first 30 days of your paid subscription, you may request a full refund by contacting support@visionaryconsultant.net. This guarantee applies once per user. After 30 days, refunds are issued at our discretion on a prorated basis.
You must provide a valid payment method. We reserve the right to suspend access if payment fails after reasonable retry attempts and notification.
You own all data you create using EstimateAI, including but not limited to:
We do not claim ownership over your data. We may use aggregated, anonymized usage data to improve the Service, but we will never access, share, or sell your individual estimate data, client information, or pricing.
We never sell your data.
EstimateAI uses a multi-tenant architecture with strict logical data isolation. Your data is segregated from all other users' data at the database level through enforced tenant identifiers and row-level security policies. No user can access, view, or modify another user's estimates, clients, photos, or pricing data.

EstimateAI uses OpenAI's GPT-4o API to process job photos and generate estimate suggestions. When you upload photos or submit data for AI analysis:
You may cancel your subscription at any time through your account settings or by contacting support. Upon cancellation:
We may suspend or terminate your account for violation of these Terms, with reasonable notice where possible. In cases of fraud, abuse, or security threats, we may terminate immediately without notice. You retain the same 30-day export window.
After the 30-day post-termination export window, we will delete your data from all primary systems within 14 days and from backups within 90 days. We will confirm deletion upon request.
The Service, including its software, design, AI models, and branding, is owned by Visionary Solution LLC and protected by intellectual property laws. Your data remains yours. We grant you a limited, non-exclusive, non-transferable license to use the Service subject to these Terms.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
You agree to indemnify, defend, and hold harmless Visionary Solution LLC, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

AI-generated estimates are based on the information and photos you provide and the AI model's interpretation at the time of processing. Results may vary based on image quality, project complexity, regional pricing differences, and other factors. No estimate produced by EstimateAI should be treated as a final quote or bid without your independent professional review and verification.
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Colorado, and you consent to the personal jurisdiction of such courts.
